ROCHESTER, N.Y. — A man who was accused of setting a fire in Rochester that killed an 8-year-old girl in 2004 is facing a new federal charge in connection to the case.

Timothy Kuhn is charged with arson of property used in interstate commerce resulting in death. An indictment filed this month alleges that Kuhn damaged and destroyed a rental property at 17 Yates Street by fire on Feb. 28, 2004, which led to the death of 8-year-old Savannah Streber.

Last year, an indictment charging him with murder and arson was thrown out. A judge ruled that a record-keeping issue within the initial 2005 investigation violated Kuhn’s constitutional rights.
Kuhn had been released from Monroe County Jail after the state charges were dismissed last year. News10NBC was present when he left the jail and was met by family members of Savannah Streber.
