Charlene Childers could face new charges according to the Wayne County DA

LYONS, N.Y. — The woman who pleaded guilty to planning the murder of her children’s father and his fiancée could face new charges.

Wayne County District Attorney officials said Charlene Childers will appear for a Domestic Violence Survivors Justice Act hearing on Monday.

Attorneys for her husband, Tim Dean, will consider whether to move forward after she admitted to perjury.

A judge sentenced Childers to 28 years in prison after pleading guilty to manslaughter in the 2018 deadly shooting of Josh Niles and his fiancée, Amber Washburn.

The shooter, her husband Dean, is serving a sentence of life in prison without parole. Dean was also a former police chief in Sunray, Texas.

Childers applied to be resentenced under New York’s Domestic Violence Survivors Justice Act. According to the New York State Bar Association, the law allows prosecutors and defense attorneys to look back at cases where a defendant was a documented victim of abuse.

Monday’s hearing follows three days of testimony last week.

The case remains under review as the court considers the impact of the new law.
