Two of three lawsuits against the Town of Greece settled; third case still pending

GREECE, N.Y. — The Town of Greece reached a settlement in two of three lawsuits brought against it in the last three years.

News10NBC’s Erin Mahon spoke with Town Supervisor Jeff McCann immediately after court.

All cases involve the town, with some also citing former Town Supervisor Bill Reilich and Deputy Supervisor Michelle Marini. Neither were present in court today.

The first case filed in 2023 involved a former town employee suing for years of off-the-clock work. The second, filed in January of last year, was from a family suing for tracking and surveilling them.

McCann was in court but did not share the details of the settlements.

“Well I can’t get into any of the details right now. There are several documents that people have to sign before it’s official and before it’s done,” McCann said. “In terms of our process, we need to get town board approval for this, which I don’t anticipate being a problem.”

McCann said that’s because there were no surprises and the town board has stayed in the loop about the cases.

Mahon asked McCann about the legal fees and how the town will pay for them.

“Yeah, so you know a portion of what the settlement dollars will be will be insurance funds with that so it won’t be all town dollars,” McCann said. “But there will be significant town dollars involved in this.”

McCann said the town will pay the legal fees from reserves. He did not give a total but noted that it cost hundreds of thousands of dollars defending all the cases together. That was part of the motivation, he says, in ensuring these cases reached a settlement so the town could move on.

The town’s insurance will cover “a good portion” of the settlements. The town does not have a final total on what insurance will cover and what remaining portion will come from reserves, as there is still one more settlement yet to be signed. This third case also involves a family alleging the town surveilled them.

Once signed, these cases are terminated and no longer have the option to go to trial.

The next Greece Town Board meeting is July 16. That’s when the board is expected to discuss and approve the settlements reached.
