ROCHESTER, N.Y. — Rochester Police say the third and final officer that was shot on Chili Avenue on Dec. 19 has been released from the hospital.
Police say 38-year-old Eric Davis shot at three RPD officers. Bodycam footage shows officers approaching Davis, where he then starts to shoot at them.

All three of the officers shot were brought to Strong Memorial Hospital the night of the shooting. RPD isn’t releasing the names of the officers at this time, so they’re numbered.
Officer #1 was discharged the day after the shooting on Dec. 20. Officer #3 was discharged on Dec. 24, and has been recovering at home. Officer #2 has been in the hospital since the shooting on Dec. 19.
Davis was shot by a fourth officer, and died at the scene.
According to RPD Chief David Smith, it all started when officers responded to reports of a man breaking into the house of his ex-girlfriend, possibly with a gun, at around 10:15 p.m. on Friday, Dec. 19. Police say the caller, the woman’s current boyfriend, told police he had his legally-owned pistol on him at the time.
When officers got to the scene, that’s when bullets started to fly. In total, Davis fired at least eight rounds at the officers, according to police. They also say Davis had an active arrest warrant for threatening to hurt the victim in October and the victim had an order of protection against him.

No charges have been filed in this investigation, and police say they don’t anticipate filing any. The shooting is still under investigation by the New York State Attorney General’s Office and RPD’s Professional Standards Section.
