On Dec. 5, Ontario County Sheriff’s Deputies say they found the victim unresponsive at the motel with injuries to his upper body. The victim was airlifted to Strong Memorial Hospital.

As a result, Justin Rogers, 27, was arrested and charged with assault. Deputies say Rogers has previously been charged with assault of a police officer, and he was known to the victim.

Shortly after the assault, News10NBC spoke with the Ontario County’s Acting District Attorney at the time Kelly Wolford, about why Rogers was charged with assault instead of attempted murder.
