Livingston County deputies: Livonia man charged with felony DWI after second arrest

LIVINGSTON COUNTY, N.Y. — A Livonia man has been charged with felony DWI after deputies said he was arrested for driving under the influence for a second time.

Michael Kurtz, 59, was arrested just before 11 a.m. Saturday, after deputies say he was seen driving while reportedly under the influence, the Livingston County Sheriff’s Office said.

Deputies said they confirmed Kurtz was under the influence during a field sobriety test and took him to the sheriff’s office.

Kurtz was previously convicted of DWI in 2025, making this latest charge a felony, the sheriff’s office said.

Deputies said Kurtz’s blood alcohol content was .12%, which is above the legal limit of .08% for drivers in New York.

He was arraigned at Livingston County CAP Court and released because he does not qualify for bail, deputies said.
