BUFFALO, N.Y. — The next phase of jury selection is now underway in the federal death penalty trial of the Buffalo Tops mass shooter.
Peyton Gendron’s trial is set for October. On Monday, the first 130 potential jurors were in federal court in Buffalo to fill out questionnaires.
About 1,200 potential jurors have been summoned. This part of the process will take about two weeks.
Some death penalty opponents gathered outside the courthouse, drawing comparisons to recent developments in the trial of the shooter behind the Club Q massacre in Colorado.
“They just took the death penalty off the table in that case and allowed him to plead to charges in that case for life without parole. That was a hate crime. Why is it different from this hate crime?” McQuillen said.
Gendron is already serving 10 life sentences after pleading guilty to murder on state charges. He shot and killed 10 Black people in a racially motivated killing spree in May 2022.
