Appeals court upholds 25-year sentence for Dansville man convicted of sexually assaulting 10-year-old girl

 

ERIE COUNTY, N.Y. — A state appeals court has upheld the predatory sexual assault conviction against John Litolff of Dansville, 41, who was sentenced back in 2024.

Litolff’s charges of predatory sexual assault and sexual abuse in the first degree were upheld on appeal by the Livingston County Court on Monday.

In 2024, he was sentenced to 25 years, the maximum sentence, after prosecutors said he raped a 10-year-old girl in Livonia back in 2018.

The appellate court rejected all arguments made by Litolff, who claimed that his conviction was based on insufficient evidence, judicial bias, improper expert testimony, ineffective counsel, and excessive sentencing.

However, the court found the evidence to be sufficient and his sentencing not to be harsh.

Litolff is currently in Wende Correctional Facility in Erie County.
